Definition
A mechanics lien (or materialmen’s lien) is a legal claim against a property that secures payment for labor or materials furnished to improve that property. If the owner or GC doesn’t pay, the contractor or sub can file a lien and potentially force a sale of the property to get paid. Requirements (notice, timing, filing) vary by state.
Why It Matters
Liens are a powerful payment remedy but must be done correctly: wrong timing or wrong notice can void the lien. Contractors and subs must know their state’s pre-lien notice and filing deadlines. Owners often require lien waivers with each payment to protect the property. Software can track deadlines and waivers.
Field Example
A sub completes work in March; state law requires lien filing within 90 days of last work. The sub sends a notice of intent to lien in April when unpaid. In May the sub files a mechanics lien. The owner pays to release the lien. If the sub had missed the 90-day window, the lien right would be lost.
